When you engage with these features, contextual information (for example, your resume data, job preferences, messages or audio recordings) is sent to the AI provider to generate relevant suggestions. These providers may temporarily store your prompts and outputs to deliver and improve their services. To the maximum extent permitted by law, Aster and its affiliates, officers, employees, agents and licensors shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services or AI-generated content, even if we have been advised of the possibility of such damages. In no event shall our total liability exceed the amount you have paid to us (if any) for the Services in the preceding 12 months.
You agree to indemnify and hold harmless Aster and its affiliates, directors, officers, employees and agents from and against any claims, damages, liabilities, losses, costs and expenses (including reasonable attorney’s fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any rights of another person; or (d) any AI-generated content you share or publish.
These Terms and any dispute arising from your use of the Services shall be governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved through binding arbitration on an individual basis in the county or state where Aster is headquartered, except that either party may seek injunctive relief in court. You waive any right to participate in class actions or class arbitrations.
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be severed and the remaining provisions will remain in full effect. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right. These Terms constitute the entire agreement between you and Aster regarding the Services and supersede any prior agreements. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights under these Terms without restriction.
